Conservative Supreme Court Justice Scalia has died (RIP): What's next?

As the title says, what's next?

There is already talk from the republicans of holding off on the appointment until the next election. That would be a nightmare if a republican won. I think Obama should hedge his bets and nominate a moderate Justice. Although history has shown that sometimes when president's appoint a justice that everyone thinks is a moderate, they actually turn out to be very not-moderate and they usually sway in the opposite direction of the President's party who appointed him/her.

I think Presidents are elected for 4 year terms not 3. Removing their decision making ability for 33% of their presidency just doesn't make sense. The agreed upon rules and procedures of our government can't be overlooked because it isn't convenient.

If he does elect a moderate with great qualifications and Republicans reject him, they'll look worse than they already do, which is tough to outdo already.

Or just to troll them he should nominate Akhil Amar from Yale. He's a liberal originalist. It'll be interesting to see how they try to dismiss someone like that.

With the Republican threat not to vote or even hold hearings on a nominee, I'd be curious to see if Obama will go the recess appointment route. I think he has six, seven days left to exercise that option?

I mean, he's not running for a third term so this couldn't possibly hurt him in any meaningful way. Plus, it'd be masterful trollery, and I can't say no to that.

Well Obama is well within his rights to nominate someone. Of course the Republicans will try to block it, though. In the same way I imagine a Democratic Senate would in this position with a Republican President. This election will be huge if so, as two branches of government will virtually be up for election.
